P.A. Duffy and Company Solicitors recently acted in a Clinical Negligence case and secured a settlement of £59,000.00 on behalf of the Plaintiff (X).
Naomi White, Solicitor, led by Gary Potter KC dealt with a case involving a problematic wisdom tooth extraction procedure.
The Plaintiff (X) attended the Defendant's (Y) clinic for a tooth extraction. Y advised X that they would carry out the extraction themselves, without conducting a comprehensive assessment of X or informing X of the risks and complications which were associated with this form of treatment. Y failed to appropriately consider any other treatment which X had previously and conducted a non-diagnostic radiograph which inadequately displayed the position of the inferior dental nerve - a critical factor to ensure a safe extraction. The extraction took place, and X left the clinic with exposed nerves and diminishing anaesthesia resulting in excruciating pain.
X visited their local Accident and Emergency Department and was prescribed a course of antibiotics. At this stage, X was experiencing numbness in the face. Unhappy with the situation, X attended hospital for a Radiological assessment which revealed that due to the current situation, it would take some months for a full examination.
The overall mishandling of the procedure, lack of appropriate radiographic assessment, absence of nursing assistance, prolonged and painful extraction and failure to arrange necessary follow-up appointments led to prolonged pain, discomfort and numbness for X.
X instructed P.A. Duffy and Company Solicitors and secured settlement in the sum of £59,000.00.
